A. Any person, firm or corporation who shall violate any of the provisions of this Ordinance or who shall fail to comply with any provisions hereof within the corporate limits of the City of Joshua shall be guilty of a misdemeanor and upon conviction shall be fined with the maximum fine in the amount of up to two thousand dollars ($2,000) for a violation of any provision governing the public health, safety, morals and welfare.

B. Each day any violation or noncompliance continues shall constitute a separate and distinct offense.

C. Any person, firm or corporation who shall violate any of the provisions of this Ordinance or who shall fail to comply with any provisions hereof within the extraterritorial jurisdiction of the City, outside the corporate limits, shall not be guilty of a misdemeanor; however, the City may institute any appropriate action or proceeding in the District Court or County Court of Law to enjoin the violation of this Ordinance.

D. The penalty provided herein shall be cumulative of other remedies provided by state law and the power of injunction may be exercised in enforcing this Ordinance whether or not there has been a criminal complaint filed.
